European Court Gives Green Flag to Super League: The European Court of Justice has granted approval for the establishment of the European Super League, asserting that the regulations of FIFA and UEFA concerning the pre-approval of club competitions violate European law. The court, the highest administrative body of the European Union, declared that FIFA and UEFA abused their “position of dominance” in opposing the creation of the contentious football Super League.

According to the ruling, the FIFA and UEFA rules requiring prior approval for interclub football competitions, including the Super League, contradicts EU law, breaching competition law and the freedom to provide services. The court argued that these rules, subjecting any new interclub football project to prior approval and prohibiting clubs and players from participating in these competitions, are unlawful. It highlighted the lack of a framework ensuring transparency, objectivity, non-discrimination, and proportionality in FIFA and UEFA rules.
“The FIFA and UEFA rules on prior approval of interclub football competitions, such as the Super League, are contrary to EU law. They are contrary to competition law and the freedom to provide services,” the ruling said.
“The FIFA and UEFA rules making any new interclub football project subject to their prior approval, such as the Super League, and prohibiting clubs and players from playing in those competitions, are unlawful. There is no framework for the FIFA and UEFA rules ensuring that they are transparent, objective, non-discriminatory, and proportionate.
Despite this ruling, the European Court of Justice mentioned that the Super League might not necessarily receive approval. A22, a sports development company involved in the Super League’s creation, welcomed the decision, asserting that football clubs are now liberated from the threat of sanctions and have the freedom to shape their own destinies.
La Liga Reacts
LaLiga, consistently opposing the European Super League, responded to the ruling, emphasizing that the court’s decision does not explicitly endorse the Super League. It highlighted UEFA’s modification to its regulations in 2022, aligning with the CJEU’s ruling.
“LALIGA stresses that the ruling of the Court of Justice of the European Union (CJEU) does not sanction the European Super League and that in 2022 UEFA already included a modification to its regulations for the authorization of new competitions, which is now adapted to what the CJEU is ruling.”
The statement clarified that the judgment does not mandate approval for specific projects like the Super League.
“Although the promoters of the Super League claim that this judgment is in their favor, the reality is that the CJEU has been clear in stating that “it does not mean that a competition such as the Super League project must necessarily be approved. The Court, having been asked generally about the FIFA and UEFA rules, does not rule on that specific project in its judgment.”
LaLiga welcomed the court’s stance, aligning with the position of 23 EU and EEA national governments defending the football pyramid against secessionist models.
“LALIGA, the only league involved with the proceedings, welcomes this statement, which is in line with the formal position expressed by an unprecedented 23 EU and EEA national governments, who joined the football and sporting community at large in defending the football pyramid against secessionist models such as the so-called European Super League.”
