A Supreme Court lawyer, Shajib Mahmood Alam, on behalf of Advocate Md Rafinur Rahman, has reportedly sent the BCB a legal notice on Shakib’s case, asking for the cricketer’s removal from the game based on the ICC’s policies and demanding Shakib return to Bangladesh.
On August 22, Shakib, who is on the Test tour of Pakistan, was named among the 156 people accused in the murder of Mohammad Rubel, a garment worker, in Dhaka’s Adabor area during the protests. The case was filed by Rubel’s father, Rafiqul Islam, against 156 local Awami League leaders and activists, which included Shakib and the then Prime Minister Sheikh Hasina.
Shakib, who was an MP of the Awami League party, hasn’t returned to Bangladesh since the party leaders, including Sheikh Hasina, fled the country as the protests grew.
Shakib Al Hasan has not returned to Bangladesh for over three weeks.
According to a report in Cricbuzz, the lawyer’s notice brought it to the attention of the BCB that since Shakib has been named in a murder case, he cannot remain in the national cricket team according to ICC rules.
However, BCB’s new president, Faruque Ahmed, said that they haven’t yet received the legal notice and will take action regarding Shakib after the completion of the first Test against Pakistan. Faruque had a meeting with BCB directors at Sher-e-Bangla National Cricket Stadium on Saturday.
“Let me say about Shakib. A case has been lodged. We are yet to get any legal notice. FIR (first information letter) was given in the case, and later there will be an investigation, and following that, the case will move in one direction or the other,” BCB president Faruque told reporters.
“Look, now we are playing a Test match, and it is very good news that we have played well on the fourth day. Tomorrow is the fifth day, the deciding day of the Test, and I think at this point, we haven’t thought about taking a stance. After tomorrow, once the game is over, we will sit down and take a decision. By this time, we will also be able to say something about the legal notice, as we will have received it by that time.”
“Look, the FIR is just the first information letter, and they are yet to claim any charge as far as I know, so before that, it is difficult to take a decision. The relationship between BCB and Shakib Al Hasan is like a player and an employer, according to the contract. After tomorrow, we can think exactly after getting the legal notice and based on that. I cannot withdraw him from the middle of the Test match,” he said.
